Terms of Service

DOINGGOODPROJECTS (Pty)Ltd (registration number 2023/130805/07), trading as Doing Good Projects ("DGP", "we", "us", "our"), operates the website www.doinggoodprojects.com (the "Site"). These Terms of Service ("Terms") govern your access to and use of the Site and the content, features, and information made available on it (together, the "Services").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Site.

1. Our Business

DGP is a media production company based in Cape Town, South Africa, creating branded films, advertisements, and other media content for commercial clients ("Client Projects").

As part of our "5% for Good" model, we pledge a portion of revenue from Client Projects, together with public donations, toward funding philanthropic film projects. Donations made in connection with this model are made to Doing Good Trust, a separate registered trust under South African law ("the Trust"). References to the Trust on the Site and in these Terms are for transparency about how this model works; the Trust is a distinct legal entity from DGP.

2. Eligibility

By using the Site, you confirm that you are at least 18 years old, or are accessing the Site under the supervision of a parent or legal guardian, and that you have the legal capacity to be bound by these Terms under the laws of South Africa.

3. Use of the Site

The Site is provided for general informational purposes - to showcase our work, services, and philanthropic activities, share blog content, and allow prospective clients and supporters to contact us.

When using the Site, you agree not to:

  • use the Site for any unlawful purpose, or in a way that infringes the rights of any other person;

  • attempt to gain unauthorised access to the Site, its servers, or any connected systems or networks;

  • introduce viruses, malware, or other harmful or disruptive code;

  • scrape, copy, or republish content from the Site without our prior written consent (see Section 6, Intellectual Property); or

  • interfere with, or disrupt, the proper functioning of the Site.

We may suspend, restrict, or modify access to the Site, in whole or in part, at any time and without notice, including for maintenance or security reasons.

4. Client Projects & Commissioned Work

The Site, including our Client Intake Form and Contact page, is intended to share information about DGP and to allow prospective clients to make enquiries. Submitting an enquiry or completing the Client Intake Form does not, on its own, create any binding agreement between you and DGP.

Any commissioned project - including branded films, advertisements, or other media production work - will be governed by a separate written quote, proposal, and/or agreement entered into directly between DGP and the client (a "Project Agreement"). Project Agreements set out matters such as the scope of work, fees, payment terms, timelines, deliverables, and intellectual property arrangements for that project.

These Terms apply to your general use of the Site. Where there is any conflict between these Terms and a Project Agreement, the Project Agreement will govern in respect of that Client Project.

All payments relating to Client Projects are arranged directly with DGP (for example, by invoice and EFT) and are not processed through the Site. See our Refund Policy for further information.

5. Donations & Doing Good Trust

Donations referred to on the Site (for example, on our donate page) are made directly to Doing Good Trust by way of EFT, using banking details provided on the Site. The Site does not process online payments, and we do not collect or store any payment card details or online banking login information through the Site.

Doing Good Trust is currently in the process of registering as a Non-Profit Organisation and is, at this time, unable to issue Section 18A tax certificates for donations received. We will update the Site once this status changes.

6. Intellectual Property

Unless otherwise indicated, all content on the Site - including text, images, video, graphics, logos, and the "Doing Good Projects" name and branding - is owned by, or licensed to, DGP and/or Doing Good Trust, and is protected by South African copyright, trade mark, and other intellectual property laws.

You may view the Site and share links to it for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, or otherwise exploit any content from the Site for commercial purposes without our prior written consent.

Ownership and licensing of content created for Client Projects, including final deliverables, are dealt with in the relevant Project Agreement.

7. Third-Party Links & Embedded Content

The Site may contain links to, or embedded content from, third-party platforms, including YouTube, Vimeo, Instagram, and Mailchimp (for our newsletter), as well as map services. We do not control these third parties and are not responsible for their content, availability, or privacy practices. Your use of any third-party platform is subject to that platform's own terms and privacy policy.

8. Disclaimers

The Site and its content are provided on an "as is" and "as available" basis. While we take reasonable care to keep the Site accurate and up to date, we make no warranties or representations, express or implied, about the completeness, accuracy, reliability, or availability of the Site or its content.

Blog posts and other informational content on the Site are provided for general interest only and do not constitute professional, legal, financial, or tax advice. You should seek independent advice before acting on any information published on the Site.

9. Limitation of Liability

To the maximum extent permitted by South African law, DGP will not be liable for any indirect, incidental, special, or consequential loss or damage arising from, or in connection with, your access to or use of (or inability to use) the Site.

Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded under South African law, including under the Consumer Protection Act 68 of 2008, or any liability for death, personal injury, fraud, or willful misconduct caused by DGP.

10. Indemnity

You agree to indemnify and hold DGP harmless from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal costs) arising out of your breach of these Terms or your misuse of the Site.

11. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes in our services, our business, or applicable law. The updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Site after any changes take effect constitutes your acceptance of the updated Terms.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising out of, or in connection with, these Terms or your use of the Site will be subject to the non-exclusive jurisdiction of the South African courts having jurisdiction in the Western Cape.
